Hi Attorneys,
Recently I have filed my H1B petition . However due to some emergency I need to quit my current organisation (Company A) who has sponsored the H1B . My questions are :
1. Would there be any adverse effect if in future Company B files H1B for me ?
2. What generally happens if I file H1B and am not able to attend the interview ?
3. Is there any way Company A can revoke the H1B petition after I resign before H1B interview ?
Would appreciate a quick a reply .

It appears you changed jobs using AC21 and went on to receive your GC. If correct, could you please post your timeline and experience?

I did my 7 th year visa transfer this year and again it took more than 2 months then nothing happened later I went for premium processing because my wife's H4 stamping date was coming closure. I guess usually it takes 2-3 months for transfering visa. Mine was Nebraska Service center. Again this year I am going for 8th year extension. Good luck for your visa transfer. Just relax and wait for USCIS reply on ur application.

I had a question about using using AC21.
Here is the scenario: Let us say I work for XYZ Company who applied for my 140 and 485. I have approved 140, H-1b, EAD and AP.
If XYZ laid me off or I left them for career progression or more money 180 days after my 485 was filed and 140 approved, what happens to my 485 application?
Wouldn't USCIS question that since my sponsoring employer does not exist anymore, who am I going to work for once I get my green card? or is this coverd under AC21?
Please advice!

Thats ok even if she doesn't have AP. That is perfectly fine. Don't worry her H4 is already stamped and she has time till next year. She is totally safe even if she does not have AP.

hi everyone
I m an MBA(major:general mba)student in a university in texas. I have an bachelors of engineeing (electrical & electronics)from india. I have found an desi employer who is ready to train me in SAP (FICO)functional and than place me on projects to diffeent companies. Since i m graduating in august 2008 ,At first i have to work for him on OPT and than in apil 2009 my employer will sponcer my h1 visa.
Now my question is....
1) can i work in SAP FICO functional , when i m on my opt?(opt means i have to work in a job directly related to my major field of study and i guess SAP is not related to my field major field of study)
2)will i have problems getting a h1b visa? (since General MBA and SAP are completely different fields )
Any comments or suggestions will be appreciated.

This info might be a little old. But I filed for PERM on Dec 1, 2010 and it got approved on Dec 19th, 2010. So, 18 days. Also, you can find the latest info for PERM approval processing time on www..com

Aliens who married or had children before the date of obtaining permanent residency can possibly confer �following-to-join� benefits to their family members. Due to this process, spouses and children will be able to receive green cards quickly. �Following-to join� is not family based immigration, but is similar to a child/spouse receiving derivative benefits based on a primary LPR�s immigration petition.

My Personal experience was:
- When my H1B was filed for the first time it had a wrong Date of Birth, lawyer asked me to bring Birth Certificate to the Interview at the consulate. I did not have problems with the stamping of the visa.
When my extension was filed , again, Date of Birth was wrong. Lawyer told me the same thing. Get recent Birth Certificate and bring it to the Interview.
Did not have any problem at all.

I've found this site to be very helpful so far and would like to ask for some opinions on my case.
My I-485 (EB2) was submitted in 2007 and the PD is approaching, only 5 days away based on June's VB. My girlfriend is currently with F-1 visa and we are planning on getting married asap so that she can submit her 485 before my case is approved.
Here's the complete list that I can think of based on the research that I've done.
Documents that my future wife's need prepare
I-485 form
birth certificate
marriage certificate
medical exam
passport pages (I-94 card ect)
I-20 form
Two photos
Documents that I need prepare
My I-485 receipt
????

Since her is the derivative GC and you are already approved there are no employment letters needed.
She needs to use AP/EAD to travel/work maintain legal status at all times.
You just need to be financially solvent just in case they ask for financial support docs I dont see that happening.
If your PD is EB3/2003 i dont think she will have to wait too long.
Too many people with PD 2001-2003 along with several 2004-2005 are approved or getting approval. anyone with Pd 2003 and above should not have to wait too long.
