Hi,
Currently working with Company A, where I have I-140 approved. The employer is willing to file I-485. Also have a better offer with Company B, and have H1B approved. Is it possible for me to take leave from company A (using my PTO) and joint company B, keeping both jobs on H1B status?
As my H1B is valid with 2 companies, and both are for full time positions. Is it okay for me to be actively employed with both companies at the same time for 2 or 3 months? Do I violate any H1B regulation, that may cause denial of I-485 at later stage?

Each month, annual preferences and foreign state limitations are subdivided by the Visa Office into monthly portions based on the applicants reported at consular posts and CIS Offices. If there is a sufficient amount of visas in a category to supply the demand then that category is considered �current� but when the demand over-exceeds the allotted supply of visas the category is considered �oversubscribed.� This is when a visa cut-off date is established, the cut-off date is the �priority date of the first documentarily qualified applicant would could not be accommodated for a visa number.�

Hi Guys,
I am working with company A on H1B, currently on bench (no pay, all vacation used up) and no pay stub. I got an from offer from Company B and have started the H1 transfer process. I would like to know how soon can I join company B. My friend says I can join as soon as USCIS receives the H1B application i.e. as soon as the fedex delivery reciept becomes available I can join the company B.
The lawyer from company B says I need to wait till a reciept notice is received from USCIS.
Who is right? I want to believe the lawyer for obvious reasons (she is a lawyer) but my friend did the similar thing, he joined the day his app was received at USCIS and he was adviced so by his company's lawyer.
A rationale to join on the same day is that when the H1 is approved it will have the start date same as the day USCIS received the app (as that is the requested start date of transfer).
I'd appreciate your inputs.

Your Petition indicates that you r applying for Professional with Advanced Degree or exceptional Ability . According to ETA 9089 submitted with ur peition the min reeqmnts you are wiling to accept are less than MS degreee. Part H of ETA 9089 indicates employer will accept BS + 72 months of Exp.
Advanced Deg is defined by US academic of Proff or a Foreign equivalent above BS. In the alternative US BS or a foriegn equiv degree followed by at least five years of progressive experience in the speciality shall be considered equiv to MS degree. ETA 9089 did not allow for any alternative combination of Education and Experience that is acceptable.
There is no other definition of Advanced Degree. Service therefore finds that the certified ETA 9089 does not support the filing of I-140 in teh requested classification. You are therefor afforded this chance to amend yout I-140.

I am currently using my EAD and working for a company remotely from my house. I also have a Permanent Resident Status in Canada. I can work remotely from Canada and my company will not have any objections to it.
Since I am on 485/EAD can I work for a US company and be on their pay roll and live in Canada? What are the ramifications?

Once you are not in US It does not matter. But as for as EAD or H1 It does not matter. Same rules apply as any other country. You have to present in US to apply and get approval for AP.
Taxes issues may be different.

I did not know that ... So the company contracting someone has to maintain an I9 information?

I am sorry to ask...If H1B doesn't have I-94 attatched to it and it was approved when my friend was in india, he can work on L1. My question is, if he moves out of country and get H1B stamped, can he work on L1?

I have a request / concern / what ever you would say.
Please do not cirtize if you do not like the idea, just ignore and leave the thread.
There are so many people comming to IV for other experts guidance on different things mainly on H1B status, AC21 status, AP, FP, EAD and H4 to EAD, .....
Why don't you create a general guide lines or rules or do's and don't or QA's for each topic, so that each member or visitor who come to IV can atleast go through them before asking or posting quesitons.
You can create a survery for different kinds of questions people / members / visitors might ask or have fore each topic before creating the thread so that we can have a pool of questions and answers for each topic from experts or attorney answered. (you might say we have recordings from attorney Prashanti Reddy, but it would be good if we have some thing which can be referred easily i.e., typed.
These are just some of my thoughts, it can or cannot be implemented. It depeneds on IV admins/Gurus/Experts on this forum.
Gurus, please provide your thoughts.

The pamphlet covers the visa process, important documents, workplace and employee rights, human trafficking, and how to file a complaint. This is a very useful document, not just for immigrants. Can any of you throw some light on these
To my understanding, if one is maxing out 6 years of H-1B visa on Nov 30, 2009 and doesn't have a way of extending to the 7th year H-1B.Then he has to stay physically outside of USA for 1 year.
1.Does 1 year stay have to be in the home country only?
2.Can one come and visit USA for a month[June 2010] or so between Nov30,09 and Nov 30,2010.[Eg: Conference, interview]?
3.If answer is yes to 2, would one have to stay for another 1 year away from July 2010? or they can come back to US during Dec 2010, if they have a new H-1B job?
Inputs appreciated.

If you didnt initially use your EAD to work, you should be fine because you have a valid H1B! See my other thread on this matter please.
