I have received my FP notice one month back and have my appointment scheduled for next tuesday. I haven't received my wife and daughter's FP notice yet. (my daughter is 7 years old)
I called USCIS 2 to 3 times and finally 10 days back they told me that my wife and daughter’s appointment also set for same date as mine and he was not sure why they have not sent me notice yet. USCIS Rep told me that he is going to send me a copy. I haven't received copy yet as of today. I called USCIS again yesterday but they couldn’t see if notice has been sent or not.
I have checked with post office and they haven't received anything either.
I am planning to go to ASC with my family and will see if they could take FP for them along with me. USCIS also suggested same but they can't guarantee if ASC will take it or not.
Has anyone experienced this before? Please let me know if you have any suggestions. Thank you!

I'm not an expert but from what I have read on various sites, nobody really knows. The thought is that the Nurse Relief bill stands little chance on it's own but may be bundled with something else to pass it.
I was told by my agency that if CIR passes, it will lift nurses out of the EB catagory and they will all be current. I have tried to find clarification on this but I don't think it is possible to speculate at this time.
I think the Healthcare reform is the first issue and then CIR will be addressed.
I have seen the figure 20,000 extra visas per year bandied round, these would be for the nurse only and the familly members would not take up any of this number. I have no idea how many nurses are waiting so don't know how this will impact on the overall figures - if indeed it ever comes to fruition.
I'm in turmoil over this as I had anticipated a lengthy wait and have embarked on a training programme to become a nurse practitioner and now worry I won't be able to complete it.
Being realistic, I would think if all EB visas become available overnight it will be sometime to process a large number, so it could take a good 12 months to get to my PD Jan 09 - I hope.
As I said at the start I am no expert so am only conveying my understanding and would welcome anyone who can correct any misunderstanding on my part.

The new fee structure goes into effect Aug 17.
I vaguely remember reading an anecdote that there is no need to pay yearly renewal fees in the new fee structure. (Am I right?) Please share your views.

Just be honest. For now you can say "No" as it is not full time. If VO asks more question on it tell them "you were not sure and ask them what it needs to be since she is doing part time. Take relavent docuemnts to show she is a part time.
All it needs to get visa is Honesty.

DHS will be rescinding its July 2 update and the initial July Visa Bulletin will take effect for 31 days � i.e., all employment-based green card categories (except for the �Other Workers� category) will be �current� and CIS will accept applications through August 17.

Does anyone know if the B1 visa can be extended in US? The visa stamp on the passport is for 6months. when entered US, the officer granted 5.5 months of stay.......
I am thinking I simply appy for B1 extension 30 days before I-94 expiry date and the actual visa stamp on the visa does not matter.....is it true

Hello All,
I am planning to start working for a new company starting June. I was wondering If I can start H1B visa transfer to the new company via premium processing(hopefully will get approved in 2-3 weeks) and continue to work for the current employer and get paid till the end of May, even the though the transfer would have been approved in the end of April.

I am getting ready to apply for PIO for our new born (born in US) but one of my friend mentioned about applying for OCI instead.
The information on eligiblity for OCI in the NewYork consulate website is little confusing. My question is since me and my wife hold Indian passports, would my new born be eligible for OCI?
Also is there something called CIO (Not Chief Information Officer)?

Me and my wife filed H1B extension through a company. I moved to consulting after my extension is approved. The consulting company filed my H1B transfer which is approved recently. Unfortunately my employer (the consulting company I moved to) dint file for my wife's H4 extension and he told that was not needed.
My question is can my wife with the petition approved from my previous employer to get her H4 stamped in India?

Hi Everyone
Just wondering if anyone in the forum can help me with this question.
My original EAD applied for in June 12, 2010 was approved on Sep 2, 2010. But, the document was lost in mail and after 90 days I was instructed by USCIS to reapply.
And, I did reapply on Oct 12, 2010 and the case is pending on initial review although I received the I-797 Notice of Action 'Replacement Receipt' on Oct 15, 2010.
According to the I-9 Receipt rule, I can start work for a period of 90 days using the 'replacement receipt' which is just a similar receipt for an I-765 application but for a replacement EAD (lost in mail). This is in the I-9 handbook in the uscis.gov site.
My question is:
According to the 90 day unemployment rule starting April 8, 2008, if we start employment using the I-9 receipt rule, do the days of unemployment still count against the aggregate of 90 days allowed after the OPT start date ?( which in my case is Sep 20, 2010.. I presume because this is the date I had provided on the approved original EAD application which was approved on Sep, 2nd, 2010 and I had lost in the mail).
So, basically in this special case where both the I-9 receipt rule & 90 day unemployment rule apply, what happens with the umemployed days accrued even if i accept employment?

Now my company has applied for my H1B extension with the details of this new passport. We got a receipt number for the H1B extension but it looks like that it will take 2 more months to get the actual extension in hand.
Recently I found that my new passport has my mother's name speling mistake (one letter wrong). I am planning to call indian embassy to make this correct. As they made this mistake while creating this new passport ( my old passport and the application had the correct mother name )
I have following questions:
1. Does embassy cancels the existing passport and issues new passport in such case ? OR
It makes correction in the existing passport.
What does it do in such cases?

I read the letter myself when it came yesterday. It clearly stated there is no appeal due to the fact that she applied to early.

On your I-485 approval, H4 status is lost and no longer valid.
Incorrect!
If the person is out of country while on H1/H4 and I-485 is approved, he/she can enter USA on valid H1/H4 visa stamp and will be offered Deferred Inspection. In most cases, they have to report within 7-14 days to local USCIS for passport stamping.
I suggest that you get more details about Deferred Inspection with your attorney.
