    According to a recent Newsweek article, Immigrants irrespective of their legal status are actually good for the job market, and boost the economy.

    Lou Dobbs, take note: immigrants are good for our economy. The most skilled create jobs in technology and engineering, says Duke professor Vivek Wadhwa, who estimates that in 2005 immigrant-founded engineering and tech companies employed 450,000 people and generated $52 billion in sales. But even the least skilled more than repay their costs in schools and health care. Two highly respected Australian economists, Maureen Rimmer and Peter Dixon, studied the issue for the libertarian Cato Institute. "The net impact on U.S. households from tighter border enforcement is unambiguously negative," they found, because even low-skilled immigrants expand the economic pie and create jobs farther up the ladder.     There is a quirk in the SSA software! I applied for SSN for my two sons on August 31, 2007. Two weeks later I got the card in the mail for one son. After waiting another three weeks I went back to the SSA office and found that the application for the second son had been deleted! I was asked to resubmit the application which I did. After two weeks the card arrived in the mail but guess what? The card had my second son's names but the SSN already assigned to the first son.
    Another trip to the SSA office revealed that their system would assume it's the same person if the first three letters of the first name and the first three letter of the last name as well as address match! Who would design such a matching algorithm? Why did they not match on birth date as well?
    Anyway, I went back to the SSA office today and a new number is yet to be assigned to my second son! I was told the application is now with their headquarters where someone will manually assign the number.

    You should speak to an immigration attorney. That's the best I can tell. False claiming to be a U.S. Citizen can lead to a permanent inadmissibility to the US. As such, it is a serious matter and should be discussed with an attorney.

    Can someone shed light on this topic?

    I know Writ of mandamus cases are common for FBI name check delays.

    What about AC 21?

    When USCIS ignored AC 21 and denied I-485, did anyone file for Writ of Mandamus?

    What are the costs involved?

    How much time does it take to get a ruling from the court?

    Per Wikipedia "The applicant pleading for the writ of mandamus to be enforced should be able to show that he has a legal right to compel the respondent to do or refrain from doing the specific act. The duty sought to be enforced must have two qualities:[3]It must be a duty of public nature and the duty must be imperative and should not be discretionary."

    The last sentence is key. AC21 is the law but USCIS issued multiple 'Memos' clarifying, making rules, giving 'recommendations' etc etc. These memos are not cast in law but sound like "discretionary". It also perhaps depends on the exact reasons for denial. Did the person get an RFE before a denial, the applicant move to same or similar job, was the I140 approved or was it merely 'approvable'. Many moving parts.

    hi,
    i am planning to file eb2 and port my eb3-i140 pd. My current position is system analyst with eb3 job requirement. I can get a promotion but that doesnt qualify for eb2 job requirement. So i am planning to move to a different position, research associate which qualifies for eb2(it requires masters degree) with the same employer. Can i file eb2 with this position and port my eb3-i140 pd? Advice pls.

    My wife'e H1B expires on Feb 2007 and she still has not applied for H1B renewal as she was on maternity leave. She will do so in first week of November. It looks like H1B extension process takes more than 3 months. Virginia is one of the states which just gives ur Driver license till ur H1B validity. So her license is valid till feb 2007. Would like to know if she can get her license renewed in Feb 2007 with a H1b receipt number or should she do Premium processing of her H1B. Any help is greatly appreciated.

    I doubt they will extend it. They will just look at I 797 and see if the name and expiry date. How ever call Identity Services (dont remember the division's name exactly) @ 804 367 0064 and explain your situation. They are the folks that generally issue a letter for H4 visa holders who do not have a I 797. They will take atleast 1 month to send the letter once they decide to do it. Start acting now! Good luck.

    I got married one year ago. My wife was born here and we filed my I-485 and I-130 and I-765 with her.
    1- my office in CT state ( hartford)
    2- I applied in April 31 2009. My sponsor was from CT and my wife is the petitioner
    3- They received my cases and cashed the checks June 10 2009
    5- In July 31 I did my biometrics test ( finger print )

    6- In Aug 2009 we moved to Michigan and My lawyer is going to transfer the case to MI
    8- october 21 they requested some evidence
    9- Nov 2009 they requested that the sponsor and the petitioner should have the same address???
    10- I changed my sponsor and I have a new one from Michigan.
    11- January 9 2010 they accepted that.
    12- Feb 3 my Lawyer surprised me and told me that I have an interview in Hartford,CT even tho she changed every thing to MI. She said she has the proof that she changed the address but it didn't update in the system and she blamed the system. she said she is going to reschedule my appointment to MI and she said the are going to send me a new notice in 2 to 3 weeks.
    13- Feb 8 2010 they ordered my EAD card.
    14- Feb 9 they mailed me a notice that they approved my I-765.
    15- My lawyer said they sent my EAD card and the notice to my old address in CT and she said they went back to them and they will re send it to my new address in MI.
    16- Feb 22 as of today they updated all my cases but without any new info ( just the dates)

    17- I am so confused and I have those questions:
    A) Did my case transfer to MI or nothing happen since I moved?
    B) how long does it take to get everthing back to the right way?
    C) what is going to happen to my EAD card and the NOTICE?

    Please help me with this and I will really appreciate it

    Hi All,
    I recently got my I140 approved and I am waiting to file my I485 as my priority date(Oct 2007) is still not current(EB2 category, India).Not sure how long it is going to take as the current backlog is July 2000 for India and China.

    My brother is a citizen of the US and I need to clarify if my brother can apply for a family-based green card for me and how long does it take to get the EAD when applied through this process as compared to filing through the employer when I reach my priority date.

    Also need to clarify if this process is sooner or still the same as applying through the employer.

    If the position you are being sponsored is 50% or more different than the position under which you have gained your experience, then experience gained in the same company can be counted. Your attorney somehow has to show that the postion you have now is more than 50% different (duties etc) than the new one. This is a tricky one and you would need a GOOOOOOD attorney to do that.

    Hi,
    My parents got their second Re-entry Permit approved (applied through Application I-131) in first week of Jan 2008. This rentry permit is valid for 2 years (i.e. till Jan 2010). They had applied for the second Re-entry Permit on 16th Feb 2007. And after applying it they left 19th Feb 2007.

    They are planning to return to US in Jan 2010 before the Re-entry Permit expiration. I read on this and other forums that with Re-entry Permit a US resident can live outside for more than 1 year and less than 2 years.

    In my parent's case, when they will return back to US in Jan 2010, they will already have spend 3 years outside US.

    I was concerned that the 2 year stay limit will be counted from the day my parents left US or the day when the Re-entry Permit got approved?

    Secondly, Is there any limit on number of times a Re-Entry Permit can be applied?

    Thanks. Yes it is within driving distance, just the city is different.

    I was tensed because I didn't know the right answer.
    With all the H1 issues going on nowadays because of location, I wanted to confirm.

    Say when I file my H1 extension, then the employer address is the going to be the new one, in the LCA.
    So was concerned if it will raise any red flags.
    What do you all think?

    Hi
    I am going to appear for H1-B interview next month.
    I was supposed to get my degree in 2000(Electronic Engineering) however due to backlogs and since I started job before degree completion I completed my degree in 2005.
    Is that a real big problem?
    Although I have double bachelors one in Electrical Engineering and other is science but my work evaluation is based on my bachelor of engineering degree.
    Please help.
