Even I am very worried about the same as my filling for H1 extn is going to come soon and due to the recent denials, I am very worried. I don't have EAD also with me and my priority date is very late. I heard about 3 cases where H1 extn is denied.
If anyone knows more details about it, please let us know.

Details: Indian, in H1-B status. Current visa stamp in passport expires in mid July but employer is applying for the extension.
The situation: I want to quit my job late this summer and relocating to Asia. Before I leave this continent, I'd like to travel around South America and maybe even do some volunteer work. I'd love to travel for at least 1 and maybe even 2 months.
Ideally, I would like to re-enter the US after this trip and collect my bags before flying to India.
What are my options for re-entering?
1) Get new H1-B stamp in passport before quitting the job (though this would be kind of a pain/expense). Quit the job, ask the company not to cancel the visa and re-enter the US after the trip on the new H1 stamp. I am guessing this is a somewhat risky option as I would technically be out of status, right?
2) How hard would it be to switch to a tourist visa and get a new stamp in a country like say Argentina or Mexico?
What do you think my best option is or am I out of luck?

I can't say which is right, but I can share my information (so far). My EAD was supposedly sent Sept. 5th. On Oct. 4th when I had not received it, I called USCIS and spoke to CSR, who put in a request for a resend of the card. I still have not received it, so after 45 days (the requested wait this time) I called again today. I have another service request number now and am told to wait another 45 days... At least the CSR admited she didn't think anything was done after I called in October! I wonder how many "45 days" they want me to wait!

Today I will be giving a presentation on immigration law along with my colleague, V. Thomas Langford, to the Air Force JAG serving at Travis Air Force Base in Fairfield, California. The Air Force JAG Corps are lawyers who provide legal advice to those serving in the Air Force.
Our training today will focus on the basics of immigration law. We will be covering family-based immigration law and outlining the procedures involved in petitioning for a family member to immigrate to the United States. We will also be talking about the Violence Against Women Act ("VAWA") and how an individual may self-petition for immigration status if he or she has been the victim of abuse or mental cruelty. Finally, we will discuss the naturalization laws as they apply to those serving in the military at a time of a conflict.
It seems that I always learn something while preparing for a presentation. While preparing for this one, I learned that staff from USCIS in Sacramento go to Travis Air Force Base twice a month to interview applicants for naturalization and administer the oath of citizenship on the same day. Kudos to USCIS for taking the time to do this. Guys,
I switched my job in first week of October this year and My new employer filed the H1B transfer petition on Sep 26 (USCIS Receipt date). It has been almost two months and USCIS online status still shows case received and pending, while California State Center processing dates shown Oct 15 which is 20 days after Sep 26.
Is there anyone who has expereineced the same and want to share?
I am bit concerned because my employer has started the GC process and will be ready to submit the PERM application in few weeks.

I had the same situation but in vermot center and it took 20 days to get transfered to the new company as i did file in Premium Processing, but a friend of mine did applied in regular as you did nd it took exactly 3 months to get it transfered.
So i think your will be done in Jan 2007 do not worry.

My second 140 may be approved by this month end.. Neb-Nov. 08-filing... i am hoping i will be able to port my PD..to 12-05

How can you change jobs if you have not filed for I485 and it has not been pending for >6months?
If you change jobs you will have to start green card process again.
If you stay with your current company, and if PD becomes current in summer, they can file for 1485 and then once your i485 is pending for >6 months you can try to change jobs using AC21.
Gurus step in and correct me if I am wrong.

Yes you would need a transit visa. In fact in Air India (not sure about other airlines) without transit visa you cannot even board the plane from US
